Hello and welcome to Learning the Law, a podcast about all things legal with a focus on current events where we try to teach you things in an hour. My name is Phoenix with my co-host and spouse, Ron. - When did political parties develop in the U.S.?
The founders of the Constitution were fearful of the rise of factions, groups in society that organize to advance a political agenda. James Madison wrote in Federalist #10 of the “mischiefs of faction” and that a large majority could seize control of the government. In 1822 he opined that he considered the existence of political parties the curse of the country.
- What were the first political parties in the USA?
- Federalist and Democratic-Republicans
The first political party, the Federalists, appeared in 1789, more than three decades before they appeared in Great Britain and other western nations. When George Washington took office as first president in 1789, he wanted an enlightened administration devoid of political parties. In pursuit of this he appointed Thomas Jefferson as secretary of state and Alexander Hamilton as Treasury secretary – thinking that two great minds while politically opposite could work together for the good of the new nation – he was wrong.
Federalists – Alexander Hamilton used his connections to organize at the grassroots/local level to represent the monied interests of the New Englanders.
Democratic-republicans – Jefferson left the administration in 1794 believing the monied interests were sacrificing the local farmers in Virginia and elsewhere.
- The first presidential election with political parties
1796 – federalist John Admas vs, Democratic-Republican Thomas Jefferson. Admas won.
- The parties “evolve”
The Federalist party starts to implode with the election of Jefferson in 1800. Infighting and separation leads to there being a non-entity by 1816. The Democratic-Republicans are then the only party with any real organization and power and eventually became known as the Democratic party. The Whig party formed in 1834 to oppose the Democrats and consisted of former Federalists, disillusioned Democrats, and various independents. This party also fractured and disappeared. The remnants were reformed in 1854 as the Republican party.
This sets the stage for the election of 1860 with Republican Abraham Lincoln winning and the Civil war to follow.

- 46.6% of Americans think the Department is too corrupt, too political, and too left leaning. This corresponds to the percentage of the population that believes whatever Trump says, so this is proof of the success of his lies and misinformation.
- The collusion between Russia and the Trump campaign have been shown to be real but not beyond a reasonable doubt to assure a criminal conviction; the laptop is a nonstory, it disappeared from the GOP talking points as soon as Biden dropped out of the race; no evidence the DOJ chilled free speech; FACE – Freedom of Access to Clinic Entrances – prosecutions are up because anti-abortion protestors have become more aggressive; the election integrity lawsuits that have been opposed are racist and have no basis in reality; mo eidence of abandoning immigration prosecutions – Biden administration has deported more people than Trump.
- RESTORING FBI INTEGRITY – Stop any Trump inventions and prosecutions; Stop investigatin the spread of dis or mis information;
- RENEWING THE FOCUS ON VIOLENT CRIME -move jurisdictions of mstates that the right does not like to the federal system; prosecute District Attorneys; Expand the crimes for the Death Penalty and kill those on federal death row
- Violent crime is in fact down;
- Pew research
- DISMANTLING CRIMINAL ENTERPRISES – Focus on Mexico, China, and Iran, ignore Russia and domestics
- Only pursue litigation consistent with Presidential agenda
- Use federal power to restrain the legislative and judicial branches
- Investigate and prosecute all government, universities and corporations that institute DEI policy.
- Emnforce the Comstock Act
- Investigate and prosecute all election integirty crimes
- Reject third party requests for politically motivated investigations and prosecution – This is exactly what this Section of Project 2025 is asking for – hypocrisy much?
- More DOJ prosecution of immigration offenses

I. Reverse the DEI Revolution in Labor – i.e. prioritize hiring straight white men
Ii. Eliminate Racial Classification and critical Race Theory training – invoice their interpretation of Title VII, prioritize the hiring of straight white males
Iii. Stop gathering racial data and interracial marriages makes such data useless. A disparity in race does not imply a racial bias.
Iv. Rescind the requirement that federal contractors need to be nondiscriminatory.
V. LGBTQIA+ can be discriminated in the workplace except in the hiring and firing process. The next admin should work on being able to discriminate against all LGBTQIA+ at any time. There should only be two sexes.
Vi. prohibit employers from offering benefits that assist employees getting abortions.
Vii. Religious employers should be free to discriminate.
Viii. EEOC should reform regulation in favor of traditional family and not woke ideology
Ix. 401k limites for married couples should be twice the limit for oindividuals
X. Mandate a day of sabbath off. Telework overtime only begins after 10 hours on the same day.
Xi. Change overtime so it can be acculated only after 2 or 4 week periods, as chosen by employer.
Xii. exempt small businesses from regulations – small business not defined nor does their appear to be any limit to this exemption.
Xiii. Revise the Apprenticeship program, allow businesses to run their own.
Xiv. Allow children to work in dangerous inherent jobs.
Xv. Eliminate BA requirement in job descriptions unless a bona fide requirement.
Xvi. Repeal Davis-Bacon requiring federal projects to pay prevailing wages
Xvii. Privatize unemployment insurance
Xviii. Federal retirement plans should not have green energy, woke policies, or investment in China.
Xix. Cap immigrant agricultural worker visa and phasedown over next 10-20 years. Cap professional immigrant worker vias and phasedown over 10 years, Federal government should only contract with American companies that manufacture goods in America.
